T-FAL BACK TO SCHOOL CONTEST 2016 OFFICIAL RULES
ENTRIES ARE FREE OF CHARGE. ONE ENTRY ALLOWED PER ELIGIBLE PERSON. NO PURCHASE NECESSARY TO ENTER. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED BY SPONSOR. Void where prohibited or otherwise restricted by law.
The “T-fal Back To School Contest 2016” contest (the “Contest”) is sponsored by Groupe SEB USA, 5 Wood Hollow Road, 2nd Floor, Parsippany, New Jersey 07054 (referred throughout as the “Sponsor”).
The Contest runs from August 14th, 2016 at 10am EST until September 11th, 2016 at 11:59pm EST. (the "Entry Period").
By participating in this Contest, entrants accept and agree to be bound by these official rules (the “Rules”) and the decisions of the Sponsor, which are final, binding, and conclusive on all matters relating to this Contest.
1.1 To enter and be eligible to win, entrants and participants must be:
(a) legal residents of the fifty (50) United States of America and the District of Columbia, who are eighteen (18) years of age or older; and
(b) at least 18 years of age, or the legal age of majority in their state of residence, whichever is greater, as of the date of entry,
1.2 You are not eligible to win if you are:
(i) an employee, agent, representative, officer or director of the Sponsor, its agents, parent corporations, affiliated companies, subsidiaries, divisions, or its promotional and advertising agencies, sponsors, suppliers of prizes, materials and services related to this Contest and administrators; or
(ii) a member of the immediate family (defined as parents, siblings, children and spouse, regardless of where they live) or their legal or common-law spouse, and any persons residing with these employees, agents, representatives, officers and directors.
1.3 The Sponsor, in its sole and absolute discretion, reserves the right to determine if an entrant meets the eligibility criteria set out in this section.
1.4 The Sponsor reserves the right at any time to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to enter or otherwise participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification.
1.5 The Contest is subject to all applicable Federal, state, and local laws and regulations. Void outside the U.S., in Puerto Rico, and wherever else prohibited by law.
2. HOW TO ENTER
2.1 No purchase necessary to enter.
2.2 To enter the Contest, simply visit the official T-fal social media outlets at:

during the Entry Period and follow the on-screen instructions to complete all fields on the entry form and answer the survey questions.
2.3 ALTERNATIVE METHOD OF ENTRY: Send a postcard during the Entry Period with your name and complete address, as follows: “ Back To School Contest 2016”, 5 Wood Hollow Rd. 2nd Floor, Parsippany, NJ 07054, Attn: Communications Department. The mailed entry must be postmarked between the Entry Period start date and received by the end of the Entry Period.
2.4 To participate to the Contest, “cookies” must be enabled.
2.5 All entries, regardless of the manner in which submitted, must be received by Sponsor within the Entry Period.
2.6 By entering this Contest, entrants consent to the use of their entry, name, city of residence, occupation, any photograph, image or other likenesses, any statements he/she makes regarding this Contest, the prize or the Sponsor’s products, and any other information contained in their entry, by the Sponsor and its respective representatives for advertising, publicity or informational purposes worldwide in perpetuity, in any medium or format (including on the Internet) without any form of compensation, benefit or notification for the purposes of promoting, administering, and holding this Contest.
2.7 Entrants must respect the following limits, otherwise they may be disqualified:
- Maximum one entry per person. If it is discovered that you attempted to enter more than once, all your entries (regardless of method of entry) will be void. One (1) entry per person regardless of method of entry even if the entrant had more than one email address and more than one product registration. In the event of a dispute, online entries will be deemed to have been submitted by the Authorized Account Holder of the email address submitted at the time of entry. "Authorized Account Holder" means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
- Proof of entry does not constitute proof of receipt of the entry by the Sponsor.
- Entries must comply with these Rules in order to be eligible.
- All entries that are incomplete, illegible, damaged, contain an erroneous phone and/or email address or do not conform to or satisfy any condition of the rules may be disqualified by the Sponsor.
- All entries become the property of the Sponsor.
3.1 There will be one (1) prize (the "Prize") awarded in the Contest, consisting of:
$500 Pre-Paid Visa or American Express Gift Card (approximate retail value: $500); and
5 piece T-fal Product Set (consistent of a T-Fal Kettle, a T-fal Opti-Grill, a T-fal Electric Pressure, a T-fal PowerGlide Steam Iron and a T-fal ProGrade Cookware (approximate retail value: $500)
The total approximate value of the Prize is $1000.
3.2 The following conditions apply to the Prize offered:
- The Prize must be accepted as described in these Rules and cannot be sold, transferred to another person, substituted for another prize, or exchanged in whole or in part, for cash.
- Any portion of the Prize that is unused will be forfeited.
- The Sponsor reserves the right to substitute the Prize or any component thereof for any reason with a prize or a prize component of equal or greater value, including without limitation, but at the Sponsor’s sole discretion, a cash award.
- Any costs or expenses incurred by a winner in claiming or using the Prize will be the responsibility of the winner.
- The Sponsor is not responsible for providing financial or tax advice. All fees, Federal, state or local taxes relating to the Prize are the sole responsibility of the winner.
- All other costs and expenses not expressly listed as part of the Prize, if applicable, are the sole responsibility of the winner.
- Any Prize represented in promotional materials is for illustration purposes only and may not be the exact item(s) offered as the Prize.
3.3 The Sponsor’s computer servers are the official time-keeping device for this Contest. The time that an entry is received by the Sponsor will be the time at which it is received by the Sponsor’s mail server or web server (as applicable) as determined in accordance with the applicable server's clock. The date/time of the postmark shall be the time-keeping device for entries submitted by mail.
4. SELECTION OF WINNER
4.1 On September 16, 2016 at approximately 2:00 pm at the headquarters of Sponsor’s at 5 Wood Hollow Rd., 2nd Floor, Parsippany, NJ 07054 the Sponsor will select one (1) winner (the “Winner”) at random from a drawing of all eligible entries received by Sponsor, regardless of method of entry. Sponsor will randomly select the potential Winner from all eligible entries received during the Entry Period. The potential Winner will be notified by mail, email or phone. Sponsor’s decisions as to the administration and operation of the Contest and the selection of the potential Winner are final and binding in all matters related to the Contest.
5. AWARDING OF PRIZE
5.1 To be declared Winner of the Prize, the potential Winner will be required to:
(a) provide the Sponsor with satisfactory proof of identification, and sign a Declaration and Release form that will be sent to the selected entrant by mail or e-mail and return it, duly completed, to the Sponsor (as directed by the Sponsor) within seven (7) days of its receipt. The Declaration and Release requires a potential Winner to confirm, except where prohibited by law, that the potential Winner:
(i) is eligible to participate in this Contest;
(ii) has read, understands, and agrees to be bound by these Rules;
(iii) accepts the Prize as awarded;
(iv) agrees to take part in a promotional media and public relation campaign, without compensation;
(v) grants all consents required and authorizes the Sponsor to broadcast, publish and disseminate his/her name and city of residence in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner, beyond the awarding of the Prize; and
(vi) releases the Sponsor, its parents, affiliates, subsidiaries, divisions, dealers, their advertising and promotional agencies, sponsors, suppliers of prizes, materials or services related to this Contest, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns from any liability and damages which could arise out of or are in any way related to the Contest and from the awarding, receipt, possession and/or use or misuse of the Prize or any component thereof;
5.2 If a potential Winner cannot be reached within five (5) business days following the first attempt of contact, declines the Prize, or fails to otherwise to comply with any of the above conditions, the Sponsor reserves the right, at its sole discretion, to select another potential Prize Winner at random from the other valid entries. In this event, the first potential Winner will be disqualified (and will forfeit all rights to the Prize) and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The procedures and requirements referred to above relating to notification and acceptance of potential Winners shall be applied, with the necessary amendments, until a qualified Prize Winner has been selected.
5.3 Selected Entrants will be contacted at the phone number and/or e-mail address provided in their entries. The Prize will be awarded only to the individual entrant named in the selected entry.
5.4 Upon receipt of the signed Declaration and Release, the Sponsors will notify the Prize winner of the manner in which he/she will have to take possession of the Prize. The Sponsor reserves the right to determine how the presentation of the Prize will occur, and this may be either a media event, by mail, or in person.
6. GENERAL CONDITIONS
6.1 Odds. The odds of winning depend on the total number of total eligible entries from all entry methods received during the Entry Period.
6.2 Verification of Entries. Entries are subject to verification by the Sponsor. Any entry form that is illegible, incomplete, fraudulent, copied or received late bearing an invalid e-mail address or phone number or otherwise noncompliant shall be rejected and will not entitle the entrant to an entry or to a Prize, as the case may be. Entrants are responsible for the correct and full completion of their entry form in order to be reached in conformity with these Rules if they are selected for a Prize.
If you are a potential Winner, you are not a Winner until the verification process is complete, and it is determined that you have complied with all terms of these Rules.
6.3 Conduct of the Contest. Any attempt to deliberately damage the Contest, official T-fal social media website or to sabotage the legitimate conduct of this Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Sponsor reserves the right to reject the Entrant’s entries and obtain legal or equitable relief under applicable laws.
6.4 Disqualification. Any person entering this Contest or trying to do so by any means which go against the intention of or are determined to be in abuse of these Rules and which would be unfair to the other participants will be automatically disqualified and the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
6.5 Release. By participating, Entrant agrees to release and hold harmless Sponsor and its respective parents, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and Prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any Prize.
6.6 Limitation of liability. ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS RELATING TO THE CONTEST OR THE PRIZE SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS' FEES AND UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any Prize. Sponsor is not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Sponsor is not responsible for any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Contest. If for any reason an entrant's Contest entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Contest, provided that, if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the Contest Prizes offered herein. No more than the stated number of Prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of Prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible Prize claims. ALL PRIZES ARE AWARDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND.
6.7 Indemnification. :Entrants and Winner will indemnify Sponsor, Released Parties and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these Rules.
6.8 Acceptance of Prize. The Prize must be accepted as described in these Rules and may not, in any case, be in whole or in part transferred to another person, replaced by another prize or exchanged for cash, except as provided in the section below.
6.9 Prize Substitution. In the event that, for reasons beyond its control, the Sponsor is unable to award the Prize as described in these Rules, it reserves the right to substitute, in whole or in part, the Prize with a prize of equal or greater value. No credit or reimbursement will be provided if the Prize is not taken.
6.10 Number of Prizes. In all cases, the Sponsor, its subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, employees, agents, representatives, officers and directors, and their suppliers of products, materials and services related to this Contest, and their employees, agents and representatives cannot be required to award more prizes than the number indicated in these Rules or to award prizes other than in accordance with these Rules.
6.11 Tampering with Contest. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
6.12 No Waiver. Sponsor's failure to enforce any term of these Rules shall not constitute a waiver of that provision.
6.13 Governing Law and Jurisdiction. EXCEPT WHERE PROHIBITED, ENTRANT AGREES THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE COURTS, STATE AND FEDERAL, LOCATED IN THE STATE OF NEW JERSEY, AND ENTRANT EXPRESSLY CONSENTS TO THE JURISDICTION AND VENUE OF SUCH COURTS. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF THE ENTRANT AND SPONSOR IN CONNECTION WITH THE SWEEPSTAKES, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE INTERNAL SUBSTANTIVE LAWS OF THE STATE OF NEW JERSEY, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES, WHICH WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF NEW JERSEY.
6.14 Acceptance of Rules. By participating in the Contest, Entrants agree to be bound by these Rules and by the decisions of the Sponsor, which will be final and will not be subject to appeal in any respect, including without limitation, any decisions concerning eligibility, disqualification of entry forms, or Prize attribution.
6.15 Entrant’s Identity. For the purposes of these Rules, the Entrant is the person whose name appears on the entry form and the Prize will be awarded to this person should he or she be declared winner.
6.16 Ownership of entries. Entry forms are the exclusive property of the Sponsor and will at no time be returned to entrants.
6.17 Modification. The Sponsor may, in its discretion, void any entry and/or withdraw, amend or terminate this Contest at any time for any reason without prior notice, but subject to the authorization of the territory applicable law.
Without limiting the foregoing, the Sponsor may withdraw, amend or terminate this Contest, in whole or in part, if, in its discretion, its determines that for any reason the Contest is not capable of or is not running as originally planned, fraud, human, printing or distribution errors, or any other causes or occurrences have compromised the administration, safety, fairness or integrity of the Contest. Any person entering this Contest or trying to do so by any means which go against the intention of or are determined to be in abuse of these Rules and which would be unfair to the other participants will be automatically disqualified and the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
6.18 Decisions of the Sponsor. Any decision of the Sponsor regarding any aspect of this Contest, including, without being limited to, the eligibility and/or disqualification of entry forms, shall be final and without appeal.
6.19 Successors Bound. These Rules shall be binding upon the heirs, executors, administrators and personal representatives of the entrants.
6.20 Intellectual Property. All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
6.21 Authorizations. By entering the Contest, Entrants agree to have their submitted name displayed on the Sponsor’s website, Twitter and Facebook page and used by the Sponsor for any purpose regarding the Contest and for publicity purposes of the Sponsor and its products at any time, without any fee or other form of compensation.
By entering the Contest, the Winner authorizes the Sponsor and its representatives to use, if required, the Winner’s names, photo, likeness, statements regarding the Prize, place of residence and/or voice for advertising purposes in connection with the Contest, without any form of remuneration.
6.22 Unenforceability. In the event of any discrepancy or inconsistency between these Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Sponsor’s social media, or point of sale, television, print or online advertising, the terms and conditions of these Rules shall prevail, govern and control.
If any paragraph of these Rules is declared or ruled to be illegal, unenforceable or void by a competent Court, then the paragraph in question shall be deemed void, but all other paragraphs not affected will be applied within the limitations of the law.
6.23 Privacy. The Sponsor respects your right to privacy. By entering this Contest, each Entrant expressly consents to the Sponsor, their agents and/or representatives, collecting, storing, sharing, and using the personal information submitted with each Entrant's entry only for the purpose of administering the Contest, including contacting, announcing, and promoting the Prize Winner.
No other use will be made of Entrants’ personal information, with the exception of Entrant who explicitly indicated when completing the entry form that he/she wish to receive more information about the Sponsor and/or its products.
6.24 Winner List: Winner List requests will only be accepted after the Entry Period has ended and no later than January 5th, 2017. For the Winner List, send a stamped, self-addressed envelope to: Winner List, “T-fal Back To School Contest 2016”, c/o Groupe SEB USA, 5 Wood Hollow Rd. 2nd Floor, Parsippany, NJ 07054 or an email request to: email@example.com.
6.25 Facebook and Twitter Not Sponsors. Facebook, Inc. (“Facebook”) and Twitter, Inc. (“Twitter”) are not sponsoring, endorsing or administering this Contest in any way. ENTRANT HEREBY RELEASES FACEBOOK AND TWITTER FROM ANY AND ALL LIABILITY OF WHATEVER NATURE IN CONNECTION WITH THIS CONTEST. ENTRANT ACKNOWLEDGES AND AGREES THAT THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK OR TWITTER.
